DMCA & Copyright Policy

LayerAxon respects the intellectual-property rights of others and expects users of the Service to do the same. This policy describes how rights-holders may notify us of alleged copyright infringement, and how affected users may submit a counter-notice. It is designed to comply with the United States Digital Millennium Copyright Act of 1998 ("DMCA"), the United Kingdom Copyright, Designs and Patents Act 1988, and the EU Directive 2019/790 on copyright in the Digital Single Market.

1. Filing a Copyright Infringement Notice

If you are a copyright owner (or are authorised to act on behalf of one) and believe in good faith that material accessible through the Service infringes your copyright, please send a written notice to our designated agent containing all of the following:

  1. A physical or electronic signature of the copyright owner or authorised agent;
  2. Identification of the copyrighted work claimed to have been infringed (or, for multiple works, a representative list);
  3. Identification of the allegedly infringing material, with sufficient detail (URL, account identifier, generation timestamp) to enable us to locate it;
  4. Your full legal name, postal address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on behalf of the owner.

Designated Copyright Agent

Send your notice by email to [email protected] with the subject line "DMCA Takedown Notice". A postal address for the registered UK entity will be provided on request.

2. Our Response

Upon receipt of a complete notice, we will (a) acknowledge receipt within five (5) business days; (b) remove or disable access to the allegedly infringing material expeditiously where the notice is facially valid; and (c) take reasonable steps to notify the affected user. We may, in our discretion, terminate accounts of repeat infringers.

3. Counter-Notice

If you believe content of yours was removed in error or as a result of misidentification, you may submit a counter-notice containing:

  1. Your physical or electronic signature;
  2. Identification of the material removed and the location at which it appeared;
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification;
  4. Your name, address, telephone number, and a statement of consent to the jurisdiction of the courts of England and Wales (or, if you are in the United States, the federal district court for the district in which you reside).

If we receive a valid counter-notice we may restore the material between ten (10) and fourteen (14) business days, unless the original complainant files an action seeking a court order against the user.

4. Misrepresentation

Knowingly making material misrepresentations in either a notice or counter-notice may result in liability for damages, including costs and legal fees, under §512(f) of the DMCA and equivalent UK provisions. Please consult a qualified attorney if you are unsure whether material is infringing.

5. AI-Generated Content

LayerAxon generates outputs using AI models. We respect the copyright in any reference material a user uploads and require that users have the rights necessary to use such material. Notices regarding AI-generated outputs that allegedly reproduce protected expression should include the specific elements alleged to be copied.

6. Trade-Mark and Brand Complaints

Complaints regarding the unauthorised use of trade marks (including the "LayerAxon" wordmark and logo) should be sent to [email protected].

7. Governing Law

This policy is governed by the laws of England and Wales, without prejudice to any rights available to copyright owners under the laws of their own jurisdictions. The courts of England and Wales have non-exclusive jurisdiction over disputes arising from this policy.
